1. Function as agent – content of our activity 1.1 All activities of our agency are subject to the follogwing standard business conditions. 1.2 We are an agent for external services. We are not executing external services but only acting as agent between our clients and the suppliers of the services, for example b&b hosts and hotels. We are also only acting as agent when we are doing more than one external service. The legal applications of a travel contract are not applicable. We are not giving a security bill for the arranged services. 1.3 On registration, our clients offer to our agency a binding contract. The clients can register in written form, oral form, by telephone or via Email. The contract comes off with our confirmation and invoice (via post, fax or Email). 1.4 The client is obliged to verify the confirmation and invoice immediately and to check whether the name, travel dates, destination, length of stay,... are correct and to complain immediately in case of an error. If the client does not complain, the contract is valid with the content of the booking confirmation. In this case there is no commitment of the agency. 1.5 The extend and content of the arranged external services result from the booking confirmation and invoice. Modifications of the arranged services are subject to be changed as soon as they result on changes from the supplier of the service on which we do not have any influence and as soon as they are not important. We reserve the right to modify the confirmed rates in case of a price increase from the supplier of the external service or in case that charges and taxes increase as they increase the rate per person as long as there are more than six months between the conclusion of the contract and the travel date. The agency informs the client 14 days before the travel date at the latest about such a subsequent price increase.
2. Warranty and responsibility 2.1 As an agent we are only responsible for the conclusion of a contract with the supplier of the external service. For eventual defects of the external service like for example accomodation, catering, transport we are not liable unless we have infringed a duty culpably. Possible defects and resulting warranties have to be claimed to the supplier of the external service. 2.2 The responsibility of our agency is restricted on the whole amount of each booking except in case of culpable dammage of life, body or health or in case of grossly negligent or deliberate negligence of duty. 2.3 Our clients are responsible for all dammages which they may cause on items belonging to the hosts or hotels. In case a dammage occurs it has to be notified immediatedly to the host or hotel. In case a client does not replace a dammage caused to the host or hotel, we as an agency have the right to obtain the sum from the client and to transmit it to the host or hotel.
3. Payment conditions 3.1 Agency for accomodation in London (short term) 3.1.1 On booking of an accomodation for up to two weeks 20 % of the total amount or at least 75 Euro per travelling person is due for payment on receiption of our booking confirmation. The rest is due at the latest 30 days before travelling. In case the booking confirmation is made within 30 days of the travel date, the whole amount is due immediately. 3.2 Agency for long term accomodation in London 3.2.1 On booking of an accomodation for more than two weeks up to one month (28 nights) the total amount is due on receipt of our booking confirmation. 3.3 Authorization for bank collection We as a supplier of external services which are offered by our agency are authorised to collect the due amounts for the booked external service in our name from the clients and to transfer it to the supplier of the external service.
4. Withdrawal of a client, modification of booking, alternative participant 4.1 Our clients can step back at any time by sending a written statement from the contract. This statement is effective on the day it arrives in our agency. 4.2 In case a client steps back from the contract we ask for compensation of the occurred expenditures including the payments we have to do for the external service. Under consideration of the usually in such a case saved expenditures, the agency charges the following cancellation fees: 4.2.1 Procurement of accomodation (short term) in London 4.2.2 Procurement of long term accomodation in London 4.3 In case a client wants to make modifications concerning the kind of accomodation, the date, the length of stay,... (booking modification), the agency has, in general, to cover the same costs as in case of a cancellation. Therefore the agency has to charge the same costs which might occur in case of a cancellation at the time of booking modification (see 4.2). As long as it concerns slight modifications which we can do without considerable additional expenses, we only charge an administration fee of 20 Euro per participant. 4.4 The client has the right to nominate an alternative participant in case he cannot travel as long as the service is not individual-related and in case the same characteristics are given (for example “adult”). The name of the alternative participant has to be given to the agency on time before the travel date. 4.5 In case a client does not travel without having given notice to the agency there is no refund of effected payments. 4.6 We suggest to take a travel cancellation insurance. This can be taken online on our website www.bed-breakfast.de via “Europäische Reiseversicherung”. Clients will receive more informations from the “Europäische Reiseversicherung” directly. 4.7 In case the lodging cannot be done in the determined house due to a cancellation from the host or hotel, the agency has the right to propose a convenient replacement accomodation to the client. In case a replacement accomodation is not available at the same rate, the agency proposes to the client the next cheaper and the next more expensive accomodation for choice. Due tu the clients choice he is either refunded or charged a supplement. 4.8 In case the client does not accept any of the choices he is refunded the whole sum paid to the agency.
5. Clients obligation to co-operate 5.1 When booking a b&b accomodation, the client is obliged to contact the host family one week before arrival at the latest and to inform them about his arrival time. If the client sees that he cannot keep the indicated arrival time he is obliged to arrange a new arrival time with the host. If the client is more than two hours late after the arranged arrival time, the host is no more obliged to wait for the client. If the client cannot stay with the host for this reason, he owes the whole amount for the b&b accomodation. The client has no right to claim for reimbursement or compensation in this case. 5.2 The client is obliged to help to avoid eventual damages or keep them small in case of occurring defaults of service. He is especially obliged to inform the agency immediately about complaints which concern our work as agent by telephone or via Email. If the complaints concern our service we will do our best to put things right.

7. Final informations 7.1 The client is not allowed to get in contact with a host concerning an eventual further stay but he is obliged to send his inquiries always to the agency which will organise a new stay. 7.2 This contract is based on the German Laws. 7.3 Place of jurisdiction for all persons who do not have a general jurisdiction in Germany is Bensheim. When using our website no personal information is saved or registered. Our web server as well as the analysis tools we use (etracker and Google Analytics) only record the access to our website and is not in any way related to the user. For our online marketing we only record general information like date, time, duration, key words, country of origin of the user, visited web pages, i.e. the first and last. This information helps us to monitor and understand the habits of visitors to our website and to improve our website accordingly. But this information does not allow us to draw conclusions concerning individual visitors. As at October 2009 |
